Three Suspects Face Charges Over Multiple Break-Ins Across Wilmington

Three suspects are in custody after Wilmington Police officers spotted them breaking into a business on Market Street. According to the Wilmington Police Department, police officers spotted a suspicious car that was wanted in connection to “multiple recent vape and tobacco store breaking and entering cases.” Wilmington Police say the officers noticed three people fleeing from the break-in at Queen Vape & Tobacco on Market Street.
Police say that after a brief vehicle pursuit ensued in an attempt to stop the suspects, the fleeing vehicle stopped at the end of the service road near Corning and all the occupants jumped out of the vehicle and ran away from the officers.
Officers arrested a 22-year-old man from Fayetteville. He has since been charged with Felony Breaking and Entering, Felony Larceny, Attempted Breaking and Entering, Felony Conspiracy, and Felony Speeding to Elude Arrest. Officers also arrested a 28-year-old and 16-year-old juvenile. They have all been charged with the same crimes.
Police say that more than $20,000 of stolen currency alongside vape/smoke products were recovered from the vehicle. The suspects are being held without bond at the NHSO Detention Center.
Understanding Burglary Charges in Delaware
Burglary charges can be found under 11 DE Code § 826 (2024). According to the statute, a person is guilty of Burglary in the First Degree when the person knowingly enters or remains unlawfully in an occupied dwelling with the intent to commit a crime therein. A person can also be charged with Home Invasion Burglary in the First Degree if they knowingly enter or remain unlawfully in an occupied building and attempt or commit any of the following felonies:
- Robbery in the First or Second Degree
- Assault in the First or Second Degree
- Murder in the First or Second Degree
- Manslaughter
- Rape in any degree
- Kidnapping in the First or Second Degree
Burglary is considered a class C felony. Any individual who is convicted of Burglary in the First Degree will receive a minimum sentence of 1 year at Level V. Burglary in the First Degree can also be charged as a class B felony if the suspect is armed with explosives or a deadly weapon or causes physical injury to any person who is not a participant in the crime. Any individual convicted of Home Invasion Burglary in the First Degree will receive a minimum sentence of 6 years at Level V.
