Suspect Arrested in Armed Vehicle Theft in Delaware
Delaware State Police arrested a 36-year-old man in connection with an armed robbery and vehicle theft that occurred last month in Millsboro. According to police, on September 29, 2024, at approximately 5:15 a.m., troopers responded to an armed robbery near the intersection of Hollyville Road and Mount Joy Road. Police conducted an investigation and discovered that two victims, a male and a female, had driven to the location together to meet an acquaintance. The female victim exited the vehicle to enter another car with the suspect. She was robbed at gunpoint. The suspect stole an undisclosed amount of cash. Meanwhile, a second unidentified suspect forced the male victim out of the vehicle. The pair proceeded to steal the vehicle. The vehicle was later recovered by detectives.
On September 30, 2024, the suspect was apprehended following a pursuit involving the stolen vehicle. The suspect was arrested and committed to Sussex Correctional Institution on $43,100 cash bond. Further investigation revealed that the suspect may have been involved in a September 29th armed robbery.
The defendant is facing charges of:
- Robbery 2nd Degree (Felony)
- Theft of a Motor Vehicle (Felony)
- Conspiracy Second Degree (Felony)
Robbery in the 2nd Degree
Robbery in 2nd Degree is considered either a class E or class D felony. An individual is considered guilty of Robbery in the 2nd Degree when, in the course of committing a theft, the person uses or threatens the immediate use of force upon another person with the intent to:
- Prevent or overcome resistance to the taking of the property or to the retention thereof immediately after the taking; or
- Compel the owner of the property or another person to deliver up the property or to engage in other conduct which aids in the commission of the theft.
Robbery in the 2nd Degree is considered a class E felony most of the time. However, if the individual committing the robbery takes control of a motor vehicle during the commission of the robbery, the charge is escalated to a class D felony. That is what the defendant is currently facing. A class D felony has a maximum sentence of 8 years in state prison. A class E felony has a maximum sentence of 5 years in state prison.
Theft of a Motor Vehicle
Theft of a motor vehicle is considered a class G felony under Delaware law. It occurs when the suspect takes, exercises control over or obtains a motor vehicle of another person intending to deprive the other person of it or appropriate it. A class G felony is punishable by up to 2 years in state prison.
