Delaware Man Arrested for Felony Drug Charges Following Traffic Stop

Recently, Delaware State Police arrested a 46-year-old man from Seaford, Delaware, on multiple drug charges following a traffic stop in Seaford. According to police, on September 17, 2024 at approximately 11:25 a.m., the Sussex County Governor’s Task Force was on patrol and saw a Chevy Silverado traveling northbound on Atlanta Road near Bucks Branch Road in Seaford with an equipment violation. Detectives proceeded to pull the truck over and speak to the driver. During the traffic stop, detectives noted that the truck’s insurance had expired and the driver could not provide any proof that he was the registered owner of the vehicle. The driver was ultimately taken into custody without incident after he refused several verbal commands to exit his vehicle. The police searched the vehicle which led to the discovery of approximately 7.68 grams of cocaine and approximately $1,821 in suspected proceeds from the sale of drugs.
After taking the suspect into custody, detectives obtained and executed a search on his vehicle which led to the discovery of approximately 1.67 pounds of cocaine, and approximately 23.793 grams of heroin.
The suspect was taken to Troop 4 where he was charged with the crimes listed below.
- Possession with Intent to Deliver a Controlled Substance, Tier 3 (Felony) – 2 counts
- Possession of a Controlled Substance, Tier 3 (Felony) – 2 counts
- Resisting Arrest
- Possession of Drug Paraphernalia – 2 counts
- Improper Window Tinting
- Failure to have Insurance Identification in Possession
- Failure to Transfer Title and Registration
Possession with Intent to Deliver a Controlled Substance (Tier 3)
Possession with Intent to Deliver a Controlled Substance falls under the Delaware category of drug dealing crimes. In Delaware, if you manufacture or deliver drugs to another person, possess drugs with the intent to deliver them, possess drugs over a Tier 3 quantity, or possess drugs in a Tier 1 quantity and there is at least one aggravating factor, you can be charged with Drug Dealing – Aggravated Possession. This is among the most serious crimes that you can be charged with in Delaware. The charge of Drug Dealing – Aggravated Possession can be charged somewhere between a class D and a class B felony. Penalties for dealing drugs in Delaware are based on a sliding scale. They become more serious when the tier quantity of the drug is higher (the weight is heavier), and if there are aggravating factors present.
In the case mentioned above, the suspect was charged with two counts of Possession with Intent to Deliver a Controlled Substance (Tier 3) and two counts of Possession of a Controlled Substance. The nature and length of the sentence will depend heavily on whether or not the suspect has any prior convictions.
