3 Delaware Residents Arrested on Drug Charges
Delaware State Police have arrested a 29-year-old, a 24-year-old, and a 33-year-old, all of Magnolia, Delaware, for felony drug charges following a search warrant of the Magnolia residence.
According to police, on October 8, 2024, members of the Kent County Governor’s Task Force and Delaware State Police Special Operations Response Team executed a search warrant at a house in Magnolia. The search warrant was obtained following an investigation of two of the main suspects and the distribution of illegal narcotics from the property. During the search warrant, detectives detained 6 individuals who were located on the property including the three suspects. One of the suspects was attempting to discard the narcotics out of the window of the property.
The ensuing search warrant led to the discovery of the following drugs:
- Approximately 182.46 grams of crack cocaine
- Approximately 72.04 grams of cocaine
- Approximately 88.65 grams of heroin
- Approximately 75.76 grams of psilocybin mushrooms
- 3 Oxycodone pills
- $1,182 USC in suspected drug dealing proceeds
- Drug paraphernalia and digital scales
The three suspects have since been taken to Troop 3 where they were charged with multiple crimes including:
- Possession of a Controlled Substance, Tier 3 (Felony)
- Possession with Intent to Deliver a Controlled Substance (Felony)
- Maintaining a Drug Property (Felony)
- Conspiracy 2nd Degree (Felony)
- Possession of Drug Paraphernalia
Possession of a Controlled Substance, Tier 3
Possession of a Controlled Substance is charged based on how much of the unlawful substance you possess. In this case, the defendants were charged with Tier 3 drug possession. Each drug has its own separate tier range for what constitutes Tier 3 drug possession. For cocaine specifically, a Tier 3 range would be more than 15 grams. For heroin, more than 3 grams constitutes a Tier 3 offense. For marijuana, it’s over 3,000 grams.
When charging an individual with a drug offense, the state of Delaware categorizes the amount of drugs into tiers ranging from Tier 1 to Tier 5. Tier 1 charges are the least serious under the law and typically result in the least serious charges. Possession of a selling quantity results in more serious charges under Delaware law.

You can be charged with Drug Dealing – Aggravated Possession if you manufacture drugs, deliver drugs to another person, possess drugs with the intent to deliver, possess drugs over a Tier 3 quantity, or possess drugs in a Tier 1 quantity and there is at least one aggravating factor. Drug dealing is the most serious offense in the category of drug crimes in Delaware. An individual who commits this offense would be charged with a class B felony. A class B felony has a maximum sentence of 25 years and a mandatory minimum sentence of 2 years in state prison.
